Reverse-Engineering Got Cheap. Your Protection Plan Probably Hasn’t Changed.

Sooner or later every hardware team hits the same question, which is file for legal protection on a circuit, or keep the board files secret and say nothing to anyone? Both approaches work, but both cost something. Filing a patent application runs one to three years and into the low tens of thousands of dollars, and the application publishes roughly 18 months in, so the schematic detail becomes public reading whether or not a claim from the application is ever granted. Secrecy is free and starts the day you decide to keep quiet, but it only protects you against theft. A competitor who buys the product on the open market and works out how it functions is free to use what they learn.

That last point used to be more theoretical than real. Reconstructing a board took a skilled engineer, a microscope, and weeks of tracing copper by hand, and that difficulty provided some protection. It is a weaker shield now. Machine learning pipelines pull a netlist out of photographs, X-ray images, and CT scans. Vision models can name parts whose markings have been sanded off. Automated delayering is bringing multilayer boards, which used to be the hard case to reverse engineer, within reach. Much of the tooling is commercial or open source and the rest can be hired out to a service bureau, so a small competitor who could never have justified building a failure analysis lab no longer needs one.
